Ghost Exclusive License

Exclusive grant

After provider-confirmed full payment, completion of delivery review and authorized delivery, Nocturna grants the named customer an exclusive, worldwide, perpetual license to exploit the delivered Ghost Production as the basis of the customer's own musical release and related audiovisual promotion, subject to the accepted package and disclosed third-party limitations. Nocturna will not resell or newly license the same Ghost Production to another customer.

Ownership and authorship

The exact accepted transaction and package determine whether included source files, stems or project files are delivered. Unless a separate signed assignment explicitly says otherwise, this License grants exclusive exploitation rights to the delivered production but does not make factual claims about statutory authorship, moral rights, publishing splits, performer rights or rights that cannot legally be assigned. The customer remains responsible for artist credits, registrations and third-party clearances.

Source files and use

You may edit, record over, arrange, mix, master, release, distribute, perform, monetize and synchronize the delivered production. You may give temporary project access to collaborators who are bound to protect it. You may not resell the production as a Ghost, template, sample pack, stock asset or substantially isolated source library, or share the delivered files outside the project.

Third-party material

Any known samples, loops, vocals, plug-ins or other third-party dependencies must be described in the Product/package facts when applicable. Exclusivity cannot exceed Nocturna's rights in third-party material. The customer must clear added recordings, compositions, trademarks and external assets and comply with any disclosed third-party terms.

Delivery review

Payment confirmation creates transaction authority but not delivery authority. Every operational Ghost transaction moves through PAYMENT CONFIRMED, RISK REVIEW and DELIVERY RELEASED. Files and new download authorizations remain unavailable until an authorized Admin records release. This review is operational and does not claim an automated fraud score.

Portfolio and history

After sale, the public catalog may preserve a factual archival SOLD record without a playable preview, source file or purchase action. Nocturna may retain private transaction and authorship evidence. Nocturna will not publicly present the customer's unreleased work as a portfolio item unless separately permitted.

Refunds and disputes

A refund or dispute places future download access and rights disposition on hold. The Ghost remains SOLD. No refund, dispute, cancellation or customer-favor resolution automatically returns it to inventory. Relisting requires a separate, documented rights basis and owner decision. Files already downloaded cannot be remotely recalled, and mandatory rights remain unaffected.
