Terms of Service

1. Platform and account

Nocturna Sounds provides free production resources, paid digital products, a customer Library, studio-service discovery and requests, quotes, project communication, scheduling, deliveries, Community membership features and exclusive Ghost Production offerings. Some surfaces may remain unavailable until their separate system control is activated.

You must provide accurate account information, keep credentials confidential and use only your own account. Nocturna may restrict an account or a specific operation when reasonably needed for security, abuse prevention, legal compliance or service integrity. Account suspension does not erase transaction, acceptance, delivery, support or audit records that must be preserved.

2. Free resources and the Library

Eligible Free Templates can be acquired without payment after authentication. A successful acquisition creates a Library entitlement. Reasonable acquisition quotas may limit new free claims; re-downloading an item already owned does not consume another claim. Files remain subject to the applicable Product License and factual availability of the delivery provider.

3. Service Requests and quotes

Customers may discover and request Mixing, Mastering, Co-Production, Ghost Production, Custom Production and 1:1 services without buying a digital product and without paid checkout or service invoicing being active. A request starts qualification and communication; it is not an accepted engagement and does not guarantee availability, price, deadline or result.

Nocturna may ask questions through the private Inbox, decline a request, or issue a versioned quote. Only the current quote accepted by the authenticated customer establishes the commercial scope, price, currency, turnaround description, revision terms and incorporated document versions. Payment, when applicable, follows separately. Scheduling is available only for an eligible accepted or paid engagement and real published owner availability.

4. Digital products

The product page and checkout show the exact Product, package, price, currency and License version. A provider-confirmed payment creates the Order and applicable Library entitlement. Free and paid digital files are licensed, not sold as ownership of Nocturna's underlying intellectual property. The Standard Product License applies to ordinary Templates and Sample Packs. A separate Ghost Exclusive License applies only when explicitly assigned to an exclusive Ghost transaction.

5. Community

Community membership is governed by the Community Terms displayed at signup. Membership access, credits, early access and service discounts depend on successful paid cycles and the current membership state. Community credits are not cash, are not transferable and cannot be redeemed outside the stated catalog rules.

6. Ghost Production

An operational Ghost Production is exclusive and sold only once through its assigned package and Ghost Exclusive License. Payment confirmation does not itself authorize delivery: every operational Ghost transaction enters delivery review and files remain held until an authorized Admin releases delivery. A refund or dispute never automatically relists a Ghost.

7. Payments, refunds and taxes

Stripe is the payment provider when a paid surface is active. Prices are presented in the stated transaction currency. Refund handling follows the effective Refund Policy and mandatory rights that cannot legally be excluded. Nocturna does not represent that Stripe Tax calculates or remits tax for these transactions. Any invoice or receipt exposed by a provider is not represented as a Brazilian fiscal document unless a separately implemented fiscal provider says so.

8. Communications and support

The Account Inbox, notifications and support surfaces are the primary operational channels. Transactional, operational and marketing messages are separate classifications and each depends on its applicable control and consent. Nocturna does not send marketing email without the relevant permission and enabled control. WhatsApp is not an active support channel unless a real owner number is configured and the feature is explicitly enabled.

9. Acceptable use

Do not attempt unauthorized access, bypass delivery controls, scrape private data, share credentials or protected download links, upload malicious or unlawful content, infringe third-party rights, misrepresent ownership of submitted materials, interfere with the platform, or use Nocturna content outside its License. Nocturna may preserve evidence and restrict the affected operation while investigating.

10. Availability and responsibility

Nocturna will use reasonable operational care but does not promise uninterrupted availability or that a creative service will produce a particular commercial outcome. Customers are responsible for backups of their own source material and for clearing third-party samples, recordings, compositions, performances, trademarks and other materials they submit. Nothing in these Terms limits non-waivable consumer or statutory rights.

11. Versions and evidence

The accepted document version, timestamp, customer, transaction and evidence hash are preserved. A later document does not rewrite a prior acceptance. Material future versions may require fresh acceptance. Questions or complaints can be submitted through authenticated Support, where the relevant history remains linked to the customer record.
